Veloura - Terms of Service

You must be at least 16 years old to use the Services. If you are under the age of majority in your jurisdiction, you may only use the Services with the involvement of a parent or legal guardian. By using the Services, you represent that you meet these requirements.

The Site provides information about Veloura, our mission, and the destinations we cover (currently Bangkok and Koh Phangan, with more to follow). When you subscribe to our newsletter, you consent to receive periodic emails from us, including updates on our founders' journey, curated local tips, promotions, and occasional marketing content. You may unsubscribe at any time using the link included in every email.

Downloadable content, such as our Bangkok & Koh Phangan Short-Stay Guide, is provided for your personal, non-commercial use only. You may not republish, resell, or redistribute this content without our prior written consent.

The Veloura App is available now as a free download on the Apple App Store and Google Play. Through the App, you can browse curated venues and guides, create an account, and purchase and redeem Packages and Bundles as described in Section 4. Use of the App is subject to these Terms and any additional in-app terms presented to you, including terms covering account registration, purchases, redemption of vouchers, and conduct within the App.

Some features of the App require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at the contact address below if you suspect unauthorized use.

Through the App, Veloura sells digital access passes to our curated guides and partner-venue vouchers, referred to as "Packages" and "Bundles." A Package unlocks our digital map and vouchers for a single destination (currently Bangkok or Koh Phangan). A Bundle unlocks both destinations together at a combined price. Current pricing is displayed in the App and on the Site at the time of purchase and is stated in Thai Baht (THB); we may update pricing, destinations, or what is included in a Package or Bundle from time to time.

We also offer bespoke event promotion opportunities for partners and organizers on our social channels and in the App, priced individually based on scope. Contact us at info@veloura-gems.com for a quote.

All purchases are final. Packages, Bundles, and individual vouchers are non-refundable and cannot be exchanged once purchased, except where required by applicable law. Each voucher is valid for one year from the date of purchase and may be redeemed once. Vouchers are personal to your account and may not be shared, transferred, or resold, though you are welcome to bring guests with you when redeeming a voucher in person. Vouchers are redeemed by presenting your QR code in the App at the applicable partner venue; some venues may require advance booking, and Veloura is not responsible for a partner venue's individual booking or service policies.

Veloura's local recommendations are currently curated by our founders, who act as Veloura's first Ambassadors. We are building a broader Ambassador Program to invite trusted community members in additional cities to contribute recommendations, stories, and local insight ("Ambassador Content") through the Services. By submitting Ambassador Content, you represent that you own or have the necessary rights to that content, and you grant Veloura a worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce, adapt, publish, and display that content in connection with operating and promoting the Services.

Ambassador Content reflects the views of the individual Ambassador and not necessarily those of Veloura. We reserve the right to review, edit, decline, or remove any Ambassador Content at our discretion, and to end an individual's participation in the Ambassador Program at any time.

Venues and businesses ("Partners") may apply to collaborate with Veloura to be featured on the Site or in the App, or to offer exclusive experiences or perks to Veloura members. Participation in the Partner Program is subject to a separate partner agreement where applicable. Veloura does not guarantee any minimum level of exposure, bookings, or revenue to Partners, and reserves sole discretion over which venues are featured.

When using the Services, you agree not to:

• Violate any applicable law or regulation;
• Infringe the intellectual property, privacy, or other rights of any third party;
• Submit false, misleading, defamatory, or fraudulent content or reviews;
• Interfere with or disrupt the integrity or performance of the Services;
• Attempt to gain unauthorized access to the Services, other users' accounts, or our systems;
• Use automated means (bots, scrapers) to access the Services without our prior written consent;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

Except for Ambassador Content and Partner-supplied materials, all content on the Services, including text, graphics, logos, the Veloura name and marks, guides, and software, is owned by Veloura or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Services without our prior written permission, except as necessary to make personal, non-commercial use of downloadable guides as described in Section 2.

The Services may contain links to third-party websites, venues, or services that are not owned or controlled by Veloura, including Partner venues. We are not responsible for the content, policies, or practices of any third party. Your interactions with Partners or other third parties, including any purchases, bookings, or experiences, are solely between you and that third party.

Our collection and use of personal data, including payment and purchase information and data collected through analytics tools such as Google Analytics on the Site, is described in our Privacy Policy. By using the Services, you consent to the data practices described there.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY VENUE, EXPERIENCE, OR RECOMMENDATION FEATURED THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS.

TO THE FULLEST EXTENT PERMITTED BY LAW, VELOURA AND ITS OFFICERS, EMPLOYEES, AND AMBASSADORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO VELOURA IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED SINGAPORE DOLLARS (S$100).

You agree to indemnify and hold Veloura harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Services, your Ambassador Content, or your violation of these Terms.

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, Partners, or Veloura. You may stop using the Services and unsubscribe from communications at any time.

We may update these Terms from time to time, including as the App and our programs evolve. We will post the updated Terms on the Site with a revised "Last updated" date. Material changes will be highlighted where appropriate. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of Singapore, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Singapore, unless otherwise required by mandatory consumer-protection law in your place of residence.
